AudioLab Privacy Policy

This Privacy Policy describes how Wisp Ai, Inc ("Wisp," "we," "us," or "our") collects, uses, discloses, sells, shares, licenses, commercializes, and otherwise processes personal information in connection with AudioLab and our related websites, products, services, features, content, and communications that link to this Privacy Policy (collectively, the "Service").

AudioLab is a platform for submitting text prompts, generating speech audio, comparing blind text-to-speech model outputs, voting on preferred voices, viewing leaderboards, and benchmarking AI models. By using the Service, you acknowledge that prompts, generated audio, votes, ratings, rankings, selections, model results, timestamps, rate-limit events, metadata, and related user content may be used to operate the Service, evaluate AI systems, generate benchmarks, create datasets, publish insights, and develop, license, sell, share, or commercialize data products as described in this Privacy Policy.

Personal Information We Collect

We collect personal information from and about users of the Service. The categories of information we collect depend on how you interact with us and the Service.

Information You Provide

Personal information you may provide to us includes:

  • Contact data, such as your name, email address, phone number, company, role, and related business contact details if you provide them.
  • Account and profile data, such as email address, authentication information, profile details returned by supported authentication providers, settings, preferences, linked accounts, and account identifiers.
  • Communications data, including messages, feedback, support requests, survey responses, and other information you provide when you communicate with us.
  • Transactional data, such as purchases, subscription details, credit balances, billing information, and other information needed to complete transactions, if paid features are offered in the future.
  • Marketing and event data, such as preferences for receiving communications, engagement with our emails or campaigns, and information you provide in connection with events, promotions, surveys, or research.
  • User content data, including prompts, text inputs, generated outputs, generated audio, speech data, votes, ratings, rankings, model selections, battle results, labels, annotations, comments, feedback, copied or shared content, and other content you submit to, generate through, or otherwise make available through the Service.
  • Benchmark and interaction data associated with user content, such as battle status, text hashes, text length, timestamps, selected models, model identifiers, comparison history, leaderboard interactions, vote selections, win/loss results, confidence intervals, benchmark task information, and similar usage context.
  • Browser-local project data, such as recent project titles, prompts, or other project history stored locally in your browser so your own sidebar can show past work.
  • Other information you choose to provide or that we describe at the time of collection.

Information Collected Automatically

We, our service providers, and our business partners may automatically collect information about your device, browser, and interactions with the Service, including:

  • Device data, such as IP address, hashed IP address used for rate limiting, device identifiers, browser type, operating system, hardware model, language settings, screen resolution, mobile carrier, and general location derived from IP address.
  • Online activity data, such as pages or screens viewed, referring and exit pages, access times, session duration, searches, prompts submitted, models compared, outputs generated, audio playback events, votes cast, battle status, rankings viewed, clicks, feature usage, rate-limit events, error logs, and interactions with emails or other communications.
  • Cookies and similar technology data collected through cookies, local storage, pixels, web beacons, software development kits, and similar technologies.

Information From Third Parties

We may receive personal information from third parties and combine it with information we collect directly, including from:

  • Third-party login or account providers, such as Google or email authentication services you use to sign in or connect to the Service.
  • Service providers that help us operate the Service or our business.
  • AI technology providers, model developers, infrastructure providers, analytics providers, and other technical partners.
  • Business partners, event partners, research collaborators, data providers, licensors, publicly available sources, and business transaction partners.

If we use Google APIs, our use and transfer of information received from Google APIs will comply with the Google API Services User Data Policy, including the Limited Use requirements, where applicable.

Sensitive Information

We do not seek to collect sensitive personal information. Do not submit government identifiers, financial account information, health information, precise geolocation, biometric identifiers used for identification, confidential information, trade secrets, personal information about others without permission, or any information you would not want processed as described in this Privacy Policy. If you include sensitive or personal information in prompts, generated audio, comments, or other user content, that information may be processed and shared as user content data.

Artificial Intelligence Technologies

The Service uses artificial intelligence, machine learning, audio generation, text-to-speech, speech synthesis, audio analysis, natural language processing, model evaluation, and related technologies. We may use third-party AI technology providers, model developers, AI platforms, infrastructure providers, and other technical partners to operate these features.

When you create a battle, we may send your prompt to moderation services and selected text-to-speech providers so they can review the prompt, generate audio, operate models, evaluate performance, improve systems, develop products, train or fine-tune models, provide safety features, and support the Service. These providers may process user content data under their own terms and privacy policies. We do not control how third-party AI technology providers use information after it has been shared with them, except where required by law or governed by our agreements with them.

AudioLab does not store full submitted prompt text in its database by default. Battle records may use text hashes and text length while generated audio is cached in private storage and served through authenticated or signed routes. We may still process full prompt text to generate audio, moderate unsafe prompts, display your own project history, debug the Service, prevent abuse, comply with law, or support features you use. Recent project titles and prompts may also be stored locally in your browser.

Before sharing user content data, we may remove obvious account identifiers, such as username or email address, where practicable. However, if you include personal information in the content itself, such as in a prompt, generated audio, or comment, that information may be shared with AI technology providers and other recipients.

How We Use Personal Information

We may use personal information for the following purposes:

  • Service delivery and operations, including account creation, email or Google sign-in, authentication, prompt processing, moderation, audio generation, model comparison, voting, ranking, leaderboards, benchmark experiences, support, and administrative messages.
  • Security and integrity, including fraud detection, abuse prevention, rate limiting, debugging, monitoring, authentication, enforcing our terms, and protecting the Service, users, and others.
  • Personalization, including remembering settings, understanding preferences, and tailoring Service-related experiences or communications.
  • Analytics and improvement, including understanding usage trends, improving features, developing new products and services, measuring performance, and conducting quality assurance.
  • AI evaluation and development, including testing, evaluating, benchmarking, improving, training, fine-tuning, and developing AI models, audio systems, text-to-speech systems, ranking systems, algorithms, tools, and related technologies.
  • Research and insights, including conducting and publishing research-related materials, model evaluations, performance comparisons, leaderboards, rankings, benchmark results, reports, analytics, and insights about AI-generated audio and AI technologies generally.
  • Data products and commercialization, including creating, publishing, selling, sharing, licensing, transferring, commercializing, or otherwise making available benchmarks, datasets, leaderboards, rankings, evaluations, reports, analytics, insights, APIs, model-quality signals, derived data, and other data products that include, incorporate, are derived from, or are based on information collected through the Service.
  • Aggregated, de-identified, or anonymized data, including creating and using data that no longer identifies you, as described below.
  • Marketing and business development, including sending marketing communications, measuring engagement, administering events or promotions, and developing commercial relationships.
  • Compliance and protection, including complying with law, lawful requests, and legal process; protecting rights, privacy, safety, and property; auditing compliance; preventing illegal or harmful activity; and establishing, exercising, or defending legal claims.
  • Business transactions, including evaluating or completing an investment, financing, merger, acquisition, reorganization, bankruptcy, sale of assets, or transfer of all or part of our business.
  • Other purposes with your consent or as otherwise described when we collect the information.

Aggregated, De-Identified, and Anonymized Data

We may create aggregated, de-identified, and/or anonymized data from personal information and other information collected through the Service. We may use, disclose, sell, share, license, publish, commercialize, retain, and otherwise process aggregated, de-identified, and/or anonymized data for any lawful business purpose, including analytics, research, benchmarking, model evaluation, model development, product improvement, marketing, commercialization, and creating data products.

Where we maintain de-identified data, we will not attempt to reidentify it except as permitted by law, such as to test whether our de-identification processes work or to comply with legal requirements.

How We Share Personal Information

We may share personal information with the following categories of recipients:

  • Service providers and contractors that help us operate the Service or our business, including hosting, database storage, private file storage, infrastructure, analytics, moderation, security, authentication, customer support, email delivery, payment processing if paid features are offered, marketing, and operations providers.
  • AI technology providers, model developers, AI platforms, text-to-speech providers, audio generation providers, infrastructure providers, and evaluation partners, including for generating outputs, evaluating, benchmarking, improving, developing, training, and commercializing AI models and related products and services.
  • Business partners and commercial recipients, including benchmark customers, data customers, data licensees, model providers, analytics customers, research collaborators, commercial partners, and other recipients to whom we may sell, share, license, publish, or otherwise disclose information or data products for the purposes described in this Privacy Policy.
  • Third parties designated by you, including when you use sharing features, connect third-party accounts, export content, or direct us to disclose information.
  • Other users and the public, including when you participate in public rankings or leaderboards, use sharing features, or when we publish data collected or derived through the Service, such as leaderboards, rankings, win rates, confidence intervals, aggregated statistics, model comparisons, benchmark results, metadata, or related insights, where permitted by law.
  • Professional advisors, such as lawyers, auditors, accountants, bankers, insurers, and consultants.
  • Authorities and others, including law enforcement, government authorities, courts, regulators, and private parties, where we believe disclosure is necessary or appropriate for compliance and protection purposes.
  • Business transferees, including counterparties and advisors in connection with any actual or prospective investment, financing, merger, acquisition, reorganization, bankruptcy, sale of assets, or transfer of all or part of our business.
  • Affiliates, including current or future parent companies, subsidiaries, and other companies under common control.

Leaderboard data, benchmark results, and certain related information may be visible to others or made public. Public information may be seen, collected, cached, copied, downloaded, screen captured, stored, indexed, and used by others. We are not responsible for such third-party use.

Sales, Sharing, Licensing, and Commercial Disclosure

We may "sell" or "share" personal information as those terms are defined under applicable U.S. state privacy laws. This may include disclosing or making available user content data, prompts where retained or otherwise processed, generated audio, votes, ratings, rankings, selections, text hashes, text length, timestamps, metadata, derived data, benchmark data, evaluation results, leaderboards, analytics, insights, or related data products to AI technology providers, model developers, benchmark customers, data customers, partners, researchers, data licensees, analytics customers, advertisers, or other commercial recipients.

We may also publish, sell, license, share, transfer, commercialize, or otherwise make available benchmarks, datasets, leaderboards, evaluation results, analytics, reports, insights, APIs, and other data products that include or are derived from personal information, user content data, or Service interactions, where permitted by law and subject to privacy rights that may apply.

The business and commercial purposes for these activities include evaluating AI models, benchmarking model performance, improving and training AI systems, creating and commercializing data products, providing analytics and insights, conducting research, developing products and services, and supporting marketing or advertising.

Cookies and Other Tracking Technologies

We may use cookies, local storage, pixels, web beacons, software development kits, and similar technologies to operate the Service, authenticate users, remember preferences, analyze usage, measure performance, prevent fraud, improve features, and support marketing or advertising.

We may permit third parties to use tracking technologies on the Service. To the extent those technologies involve a "sale," "sharing," or targeted advertising under applicable law, you may have the right to opt out as described in the U.S. state privacy rights section below. Most browsers allow you to remove or reject cookies, but doing so may affect Service functionality.

We currently do not respond to browser "Do Not Track" signals because no uniform standard for those signals has been adopted. Where required by law, we will honor recognized opt-out preference signals, such as Global Privacy Control, on supported browsers or extensions.

Your Choices

Depending on your location and how you use the Service, you may have choices regarding your personal information:

  • Account information. If account settings are available, you may review and update certain account information by logging into your account.
  • Marketing communications. You may opt out of marketing emails by following the unsubscribe instructions in those emails or by contacting us. We may still send non-marketing communications, such as Service, security, legal, or account messages.
  • Cookies. You may control cookies through browser settings. Some features may not work properly without cookies.
  • Privacy rights. You may contact us to exercise privacy rights that may be available under applicable law.
  • Local project history. You can clear browser-local project history by clearing site data in your browser.
  • Content choices. Do not submit information to the Service that you do not want processed, shared, sold, licensed, commercialized, published, or made public as described in this Privacy Policy.

Retention

We retain personal information for as long as necessary or appropriate to provide and secure the Service, maintain accounts, cache generated audio, create and preserve benchmarks and datasets, support data products, share information with AI technology providers and commercial recipients, conduct research, develop products, commercialize the Service, comply with legal obligations, resolve disputes, enforce agreements, prevent fraud and abuse, troubleshoot issues, assist investigations, and establish, exercise, or defend legal claims.

Once information has been disclosed to AI technology providers, benchmark customers, data customers, researchers, data licensees, public repositories, or other third parties, we may not be able to control or delete copies retained by those third parties. We may retain aggregated, de-identified, or anonymized data indefinitely.

Security

We use reasonable technical, organizational, and physical safeguards designed to protect personal information. Provider API keys and service-role credentials are intended to be kept server-side, generated audio storage is intended to be private, and IP addresses used for rate limiting may be stored as salted hashes rather than raw IP values. However, no internet, electronic, or storage system is fully secure. We cannot guarantee that personal information will be secure, and you provide information at your own risk.

International Data Transfers

We are based in the United States and may use service providers, AI technology providers, business partners, and infrastructure located in the United States and other countries. Your personal information may be transferred to, stored in, or processed in countries that may not provide the same level of data protection as your jurisdiction. Where required, we rely on appropriate safeguards or lawful transfer mechanisms for international transfers.

Children

The Service is not intended for anyone under 18 years of age or the age of majority in their jurisdiction, whichever is higher. We do not knowingly collect, sell, share, or market personal information from children. If you believe a child has provided personal information to us in violation of this Privacy Policy, contact us at contact@tryaudiolab.ai.

Other Sites and Services

The Service may contain links to websites, applications, models, APIs, services, or content operated by third parties. We do not control those third parties and are not responsible for their privacy practices. Your use of third-party services is governed by their terms and privacy policies.

U.S. State Privacy Rights Notice

This section applies to residents of U.S. states with applicable consumer privacy laws, including the California Consumer Privacy Act, as amended ("CCPA"), and similar laws. Rights vary by state and may be limited by exceptions under applicable law.

At or before collection, California residents have the right to receive notice of the categories of personal information we collect, the purposes for which we use it, whether we sell or share it, and how long we retain it. Business and Commercial Purposes

We use personal information for the business and commercial purposes described in this Privacy Policy, including providing and securing the Service, improving products, creating benchmarks and datasets, evaluating and developing AI models, conducting research, publishing insights, selling or licensing data products, marketing, compliance, and business transactions.

Disclosures, Sales, and Sharing

In the preceding 12 months, we may have disclosed Categories A, B, D, F, G, H, I, and K for business or commercial purposes, depending on how you used the Service. Recipients may include service providers, AI technology providers, model developers, business partners, commercial recipients, professional advisors, authorities, affiliates, and business transferees.

In the preceding 12 months, we may have sold or shared Categories A, F, G, H, and K, including through disclosures of user content data, generated audio, text hashes, text length, derived data, benchmark data, analytics, or online activity data to AI technology providers, model developers, benchmark customers, data customers, partners, researchers, data licensees, analytics customers, advertisers, or other commercial recipients, where permitted by law.

We do not have actual knowledge that we sell or share personal information of individuals under 16 years of age.

Sensitive Personal Information

We do not seek to collect sensitive personal information. We do not use or disclose sensitive personal information for purposes that require a right to limit under the CCPA unless we provide the required notice and choice.

Your Rights

Depending on your state, you may have rights to:

  • Know whether we process your personal information and access that information.
  • Request information about categories of personal information collected, sources, purposes, recipients, sales, and sharing.
  • Correct inaccurate personal information.
  • Delete personal information.
  • Obtain a portable copy of personal information.
  • Opt out of targeted advertising, sale of personal information, sharing, or certain profiling.
  • Limit certain uses or disclosures of sensitive personal information, where applicable.
  • Appeal a denial of your privacy request.

We may ask for additional information to verify your identity and residency. You may use an authorized agent where permitted by law, but we may require proof of authorization and may ask you to verify your identity directly.

To opt out of sale or sharing, contact us at contact@tryaudiolab.ai with the subject line "Privacy Opt-Out." Where required by law, we will honor recognized opt-out preference signals, such as Global Privacy Control, on supported browsers or extensions.

If we deny a request and your state provides an appeal right, you may appeal by contacting contact@tryaudiolab.ai with the subject line "Privacy Appeal."

Notice to European Users

This section applies to individuals located in the European Economic Area, the United Kingdom, or Switzerland.

Controller. Wisp Ai, Inc is the controller of personal information processed under this Privacy Policy, except where we state otherwise.

Legal bases. We process personal information under the following legal bases:

  • Contract, where processing is necessary to provide the Service, manage accounts, process transactions, or take steps you request.
  • Legitimate interests, where processing is reasonably necessary for our business interests and not overridden by your rights and interests, including operating, securing, improving, analyzing, and commercializing the Service; creating benchmarks and datasets; evaluating and developing AI systems; sharing user content data with AI technology providers and commercial recipients; conducting research; preventing fraud; enforcing terms; and communicating with users.

  • Legal obligation, where processing is necessary to comply with law or legal process.
  • Vital interests, where processing is necessary to protect someone from serious harm.

Your rights. Subject to applicable conditions and exceptions, you may have rights to access, correct, delete, restrict, or object to processing of personal information; request portability; withdraw consent; and lodge a complaint with your local data protection authority. International transfers. When we transfer personal information outside Europe, we rely on appropriate safeguards or lawful transfer mechanisms, such as standard contractual clauses, adequacy decisions, or other mechanisms recognized by applicable law.

Depending on where you live, including Canada, Australia, New Zealand, South Africa, or other jurisdictions, you may have rights to access, correct, delete, restrict, object to, or complain about processing of personal information. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. The updated version will be indicated by the updated effective date. If we make material changes, we may notify you by posting a notice through the Service, emailing account holders, or taking other steps required by law. Your use of the Service after the effective date of an updated Privacy Policy means the updated Privacy Policy applies to your interactions with the Service and our business.
